Terms for the Christmas song

1. Scope and provider

These terms apply to the purchase of a personalised Christmas song on adventcalendarmaker.co.uk. The advent calendar editor is governed by the general terms of use of this website.

The provider is Sun Media Brands LLC, 2880 W Oakland Park Blvd, Suite 225C, Oakland Park, FL 33311, United States. Contact: [email protected].

Different terms of the customer only apply if we have expressly agreed to them in writing.

2. What you get

Based on your answers in the form, we create personalised song lyrics and a matching audio recording. Both are made with the help of generative artificial intelligence. We use a specialised service provider for the technical production.

The lyrics and a 45 second preview are free. Only unlocking the full audio file is paid. The price is shown on the order page.

3. Contract, prices and payment

The form and the preview are not yet a contract. By clicking the pay button and completing the payment you make a binding offer, which we accept by unlocking the song.

All prices are final prices. Payment is processed by Stripe; the available payment methods are shown on the payment page.

4. Delivery

After payment you can download the audio file as an MP3 directly on the order page. We also email you the link to this page, where email delivery is available.

We keep the lyrics and the recording available for download for at least 90 days after purchase. Please save the file yourself within that time.

5. Usage rights

Once paid in full, we grant you a simple, transferable license to the lyrics and audio file created for you, unlimited in time, territory and content. This expressly includes public and commercial use, for example at a Christmas party or on social media.

The license is not exclusive. We do not publish your song or use it as a sample unless you expressly allow us to.

6. AI generation and copyright

Under the current law in the United States, the European Union and the United Kingdom, content generated purely by a machine may not be protected by copyright. We therefore do not warrant that your song is protected by copyright. You may use the song as described above, but you may not be able to stop others from using a similar song.

7. Your answers

You are responsible for making sure your answers do not infringe the rights of others, such as names, trademarks or other people's lyrics. Please only mention people who would be happy with a song about them.

We do not create content that is offensive, discriminatory or unlawful.

8. Your right to cancel

Under the Consumer Contracts Regulations 2013 you normally have 14 days to cancel an online purchase. For digital content that is not supplied on a physical medium, this right ends once we have started supplying it with your express consent and your acknowledgement that you lose the right to cancel.

That is exactly what you agree to when you click the pay button on the order page; the notice sits directly under the button. The song is unlocked immediately after payment, so the right to cancel ends at that point. Before buying, you can read the full lyrics and listen to the preview for free.

Your statutory rights for faulty digital content are not affected: if something goes wrong or the file is not usable, write to us at [email protected] and we will repair or replace it, or refund you.

9. Privacy

We use your answers and your email address to create and deliver your song. While you have not bought the song, we remind you about it by email at most three times; every reminder contains an unsubscribe link. For this we pass the song details on to our technical service provider. Payments are processed by Stripe. More in the privacy policy of this website.

10. Liability

To the extent permitted by law, our liability is limited to the price paid for the song. This does not apply to intent, gross negligence or injury to life, body or health.

11. Final provisions

These terms are governed by the laws of the State of Florida, United States. Mandatory consumer protection laws of the part of the United Kingdom where you live remain unaffected.

If any provision of these terms is invalid, the rest of the contract remains in effect.
